8Recently, the Supreme Court of India (Supreme Court) in the case of Palam Gas Service (the taxpayer) held that when the entire scheme of obligation to deduct the tax at source and paying it over to the government is read holistically, it cannot be held that the word 'payable' occurring in Section 40(a)(ia) of the Income-tax Act, 1961 (the Act) refers to only those cases where the amount is yet to be paid and does not cover the cases where the amount is actually paid. Accordingly, Section 40(a)(ia) of the Act covers not only those cases where the amount is ‘payable’ but also when it is ‘paid’ and tax has not been deducted on the same.

There is a seductive argument for a carbon tax in India. But what should be the optimal tax rate?
8A full blown analysis of emission mitigation opportunities are investigated taking into account a tax that increases in equal yearly increments of Rs 165 per tonne to reach Rs 2301 per tonne by 2030
8The carbon tax has been found to be the most suitable way of bring down emissions in comparison to host of other measures, ranging from a road fuel tax to encouraging higher efficiency, power sector feebate, renewal subsidy, excise on electricity to a coal excise tax.
8The impact of the carbon tax on the pricing matrices of various industrial segments in India is thoroughly investigated in the report and it has been found to be marginal.
8The carbon tax will reduce energy-related CO2 emissions by about 8 percent and 22 percent below BAU levels in 2020 and 2030 respectively. These results are driven almost entirely by reductions in coal use, which account for 98% of the CO2 reduction and 2 per cent coming from the oil and gas sector

While the gas sector may have won the battle against coal, it may face a fate similar to coal in its battle against the renewal fuel industry.
8No fresh coal based generation capacity is being built anymore and existing units are being retired.
8Most governments are also beginning to recognize that reliance on coal -- and some of them are now saying gas -- expose their economy to price volatility on the global markets and decreases their energy security. These considerations, combined with increasing cost competitiveness of renewables, means that investment in new fossil fuel generation capacity is slackening off.
8In India, gas sector investments remain unviable in comparison with the coal industry but the future of gas-based power is also threatened by the growth from the competitive renewable power segment.
8At the end of 2015, 23.7% of power was coming from renewable sources of energy, and investment in renewables continues to gather pace. In 2016, wind and solar PV constituted 78.4% of new capacity in the EU, in the US almost two-thirds of new capacity was renewable, and in China combined new capacity in wind and solar reached 52 GW and was roughly equal to the new capacity in coal and gas. Even more positively, over the last seven years alone, solar PV costs have come down 85%, meaning it already outcompetes fossil fuel generation capacity in many regions of the world.

Policy makers in India will now have to take into account a vigorous new campaign emanating from amongst the global climate lobby for toning down the growth of high cost, energy intensive gas supply options, such as LNG exports.

The shipping industry continues to remain cynical about the use of LNG as a bunker fuel
8LNG has the attraction of producing slightly less carbon emissions but this has to be set against the potential dangers of methane leaks as methane is a more lethal greenhouse gas than CO2.

8The other major unknown is the extent to which the current lack of LNG infrastructure will be addressed before 2020.

The newest challenge for gas seems to be the challenge thrown in its way by the emerging renewable sector.
8Even in countries gas producing countries, where the price of gas is much lower than in India, renewables such as onshore wind power, solar even nuclear and bio mass sources have begun competing with gas based power.
8In India therefore, expect for its use in the regulated sectors like fertilizers under an average price regime, will the use of gas be limited to the feedstock segment, such as petrochemicals, only instead of the energy sector as a whole?
8If methane leakage is taken into account while calculating the intrinsic cost of gas, along with a carbon tax, the future of gas can become as uncertain as the use of coal.

One of the reasons why both RIL-BP combine and ONGC are investing in the geologically unstable and high cost deepwater fields in the KG Basin is because the economics of their production are not the same as gas producers in other parts of the world.
8Their breakeven levels can be far higher than in gas producing countries for the simple fact that given the demand-supply gap in India, the price of fresh domestic supply is pegged to the landed price of LNG in India.
8Indian companies stand to make money even if their cost of production is a multiple of the cost of production in the US or the Gulf as a consequence.
8Given falling price of equipment and services, if the bulk of the expenditure over the next five years can be locked in 2017 before their prices are projected to go up, the rate of return on KG Basin oil production is likely to remain well above the hurdle rate.

Nothing highlights the highly regulated nature of the Indian gas industry than the fact that largest consumers of gas are those where the gas prices are regulated.
8Of the available 140 mmscmd of total gas, the fertilizer sector consumes 4128 mmscmd, followed by power at 31.97 mmscmd and city gas at 21.19 mmscmd
8Industrial consumption, which is dependent on RLNG, is a mere 1.46 mmscmd
8The petrochemicals sector and the refinery sector, including the production of LPG, along with shrinkages etc make up the rest
8There is no immediate possibility of deregulation of the fertilizer and CGD sector
8Gas based power demand will come under increasing pressure from renewables and coal based power is unlikely to disappear from the horizon any time soon.
8That leaves only a very narrow segment from where the bulk of the future gas demand in India is likely to come from.
8Unless there is a large tax on carbon, coal based sources will continue to dominate, followed by renewable energy.
8Gas, because it is far more expensive in India to use because it needs to be imported, will continue to remain dependent on a narrow segment for growth.

8Net natural gas production available for sale from domestic production was less by 1.25% from the previous year
8The gap was plugged by LNG imports which grew by 15.8% during the period.
